The court found that the Nairobi and Mombasa judicial review applications arise from the same procurement decision and involve overlapping parties and issues. The likelihood of conflicting decisions is real if the matters are heard by different judges. The court held that it has inherent jurisdiction under section 3A and the overriding objective provisions of the Civil Procedure Act to transfer proceedings to promote justice and efficiency. The administrative territorial divisions of the High Court do not oust its unlimited jurisdiction. The principle from Stumberg and Another v Potgeiter, though addressing consolidation, applies by analogy to the transfer of related matters to one judge....
