Procedural Posture

Miscellaneous Application / Ruling on Substantive Judicial Review Application

  1. 1 Whether the Provincial Land Appeals Committee had jurisdiction to nullify a registered proprietor's title to land.
  2. 2 Whether the tribunal's decision to direct transfer of registered land was ultra vires its statutory mandate.
  3. 3 Whether the applicant was entitled to orders of certiorari and prohibition against the tribunal and land registrar.

Ratio Decidendi

The court found that the Provincial Land Appeals Committee exceeded its statutory jurisdiction by purporting to nullify the deceased's registered title and direct transfer of the suit land. The Land Disputes Tribunals Act only empowers tribunals to determine disputes relating to division, boundaries, occupation, or trespass to land, not title. Disputes over title must be determined by the High Court or, in limited cases, the Resident Magistrate's Court. The tribunal's decision was therefore ultra vires and void. The applicant was entitled to orders of certiorari to quash the tribunal's award and prohibition to restrain the adoption and implementation of the award by the Magistrate's Court...
