The court found that the Public Procurement Administrative Review Board lacked jurisdiction to entertain the request for review filed by the 2nd Respondent because a contract had already been signed between the applicant (Four M Insurance Brokers Limited) and the procuring entity (Kenya Pipeline Company Limited) on 2nd October 2023. Section 167(4)(c) of the Public Procurement and Asset Disposal Act expressly ousts the Board's jurisdiction once a contract is signed in accordance with Section 135.
