Procedural Posture

Criminal Case / Judgment

  1. 1 Whether the accused was properly identified as one of the persons who attacked the deceased.
  2. 2 Whether there was a nexus between the accused and the fatal injuries that caused the deceased's death.
  3. 3 Whether the prosecution proved the charge of murder beyond reasonable doubt.

Ratio Decidendi

The court found that while the evidence established the presence of the 1st accused at the scene of the altercation, it did not establish beyond reasonable doubt that he or his group inflicted the fatal injuries on the deceased. The only eyewitness, PW9, did not see the deceased being wounded in a manner consistent with the fatal injuries, and the body was found in an area previously searched without success, raising doubt as to when and by whom the fatal injury was inflicted. The prosecution failed to create a nexus between the accused and the death of the deceased. The benefit of doubt was given to the accused, resulting in an acquittal.
