Ratio Decidendi

The court found that the Registrar of Motor Vehicles, as the custodian of vehicle records, was required by the rules of natural justice to give the ex-parte applicant an opportunity to be heard before altering the registration of motor vehicle KAY 082A to his detriment. There was no evidence that such an opportunity was provided. The ex-parte applicant, having been issued a duplicate logbook, was entitled to assume ownership under section 8 of the Traffic Act. The Registrar's failure to hear the applicant before changing the register constituted a breach of natural justice.
