Ratio Decidendi

The court held that the power to cancel or correct entries in the land register on grounds of fraud or error is, in the first instance, vested in the Registrar of Titles under Section 60 of the Registration of Titles Act. The court cannot, through judicial review, compel the Registrar to reach a specific decision such as cancellation of entries, but may only require the Registrar to consider the application and provide reasons for the decision. The applicant's request for an order of mandamus compelling the Registrar to cancel the entries was therefore beyond the court's authority in judicial review proceedings. Additionally, Section 59 of the Act does not apply to cases of alleged fraud...
