The court found that awarding costs against the judicial officer (1st applicant) was an error apparent on the face of the record, as judicial officers are protected by absolute immunity under Article 160(5) of the Constitution and Section 6 of the Judicature Act for acts done in good faith in the performance of judicial functions. The Attorney General (2nd applicant) was joined only for purposes of enforcement and representation, and should not have been condemned to pay costs. The court held that the error was substantial and self-evident, warranting review under Order 45 of the Civil Procedure Rules.
