The court found that the prosecution had adduced credible evidence showing that the deceased died as a result of stab wounds inflicted on the night in question, and that the accused was placed at the scene by PW1's testimony. The court held that, at this stage, it is not required to make final determinations on credibility or weight of evidence, but only to assess whether a prima facie case exists. Applying the principles from Ramanlal Trambaklal Bhatt v Republic, the court concluded that the prosecution had established a prima facie case sufficient to require the accused to be placed on his defence for the charge of murder.
