Ratio Decidendi

The court found that the Rift Valley Province Land Disputes Appeals Committee lacked jurisdiction to hear and determine the dispute because there was no reference to the Land Disputes Tribunal at first instance as required by section 3 of the Land Disputes Tribunal Act. The Appeals Committee's jurisdiction is appellate only and is triggered by a decision of the Tribunal. Since no such decision existed, the Appeals Committee could not lawfully entertain the matter. Any decision made without jurisdiction is null and void ab initio. The court therefore granted an order of certiorari to quash the decision of the Appeals Committee dated 18/10/2002.
