The trial magistrate imposed fines of Kshs 25,000 and Kshs 5,000 on the accused persons for overloading offences where the law prescribes a mandatory minimum fine of Kshs 200,000 for exceeding 10,000kgs. This was contrary to Rule 41(2) of the Traffic Rules and Section 58(1) of the Traffic Act. The High Court found the sentences to be illegal and, exercising its revisionary jurisdiction under Section 364 of the Criminal Procedure Code, set aside the illegal sentences.
