Procedural Posture

Criminal Case / Ruling on Case to Answer Under Section 306 of the Criminal Procedure Code

  1. 1 Whether the prosecution has established a prima facie case against the accused persons to warrant putting them on their defence.
  2. 2 Whether the evidence adduced sufficiently links the accused persons to the offence of murder.
  3. 3 Whether the identification of the accused persons was positive and reliable.

Ratio Decidendi

The court found that the prosecution had adduced sufficient evidence to establish a prima facie case against both accused persons. There was evidence of the death of the deceased, the accused persons being placed at the scene of the crime, and a weapon recovered from the 1st Accused's residence. Although the defence raised issues regarding identification and contradictions in the prosecution's case, these matters were not sufficient at this stage to warrant an acquittal. The threshold for a prima facie case as set out in Ramanlal Trambaklal Bhatt v R was met, and the accused persons were accordingly put on their defence.

Court Disposition

Accused persons put on their defence.
