The court found that the Political Parties Dispute Tribunal had jurisdiction to entertain Complaint No. 5 of 2020, as the dispute fell within the scope of section 40 of the Political Parties Act and there was evidence that the respondents had attempted to resolve the matter internally with the 4th respondent without success. The ex-parte applicants failed to prove that the Tribunal acted outside its jurisdiction or in excess of its mandate. Regarding the sub judice argument, the court noted that no pleadings were provided to establish that the substance of Kakamega CMCC No. 162 of 2019 was the same as Complaint No. 5 of 2020, and thus the sub judice rule was not substantiated....
