Ratio Decidendi

The court found that the prosecution failed to adduce any cogent evidence linking the accused persons to the murder of the deceased. All prosecution witnesses were not eyewitnesses and only relayed information received from others, none of whom were called to testify. The only evidence suggesting involvement of the accused was inadmissible hearsay. Applying the test from Ramanlal Trambaklal Bhatt vs Republic, the court held that no prima facie case had been established against the accused persons. Consequently, there was no basis to require the accused to be put on their defence, and they were acquitted under Section 306(1) of the Criminal Procedure Code.
