Although there was evidence of an altercation between the accused and the deceased the night before the body was found, credible testimony showed the deceased was alive and active the following day. No direct or circumstantial evidence linked the accused to the murder, and the prosecution did not prove the elements of murder beyond reasonable doubt. The evidence presented was insufficient to require the accused to be put on their defence. Accordingly, the court acquitted the accused persons under Section 306(1) of the Criminal Procedure Code.
