His co-accused had pleaded guilty to the charge and was convicted and sentenced. 2.On 6/7/2026 when the matter came up for hearing, the accused requested for the charges to be read afresh which was done and he pleaded guilty to the charge. 3.The facts were read to him and he confirmed them to be true. He was thus convicted on his own plea of guilt. 4.The accused mitigated and pleaded for the leniency of the court. He admitted not knowing that he was not allowed to cut the said trees as he considered them family mango trees. 5.I have considered the mitigation of the accused and the submission by the prosecution that the accused is a first time offender, further, I have considered the Sentencing guidelines while giving out this sentence. 6.Therefore, the court fines the accused KShs. 10,000 or in default he shall serve 3 months imprisonment. 7.The accused has 14 days right of appeal DATED, SIGNED AND DELIVERED AT HOLA IN OPEN COURT THIS 9TH DAY OF JULY, 2026.W.
