The prosecution did not call the doctor or investigating officer, and the evidence adduced was deemed worthless. Applying the standard from Bhatt v R, the court held that no reasonable tribunal could convict on the evidence presented, and therefore the accused was entitled to an acquittal under Section 306(1) of the Criminal Procedure Code.
