RE-S E N T E N C I N G
1. I have considered the mitigation by the accused. I have also considered that he is a first offender. I have also considered the victim Impact Report on record.
2. Although a life was lost, I have considered that it occurred is very unfortunate circumstances where the accused’s son the deceased attempted to attack the accused. That the accused acted in self defence. The accused age is 80 years now.
3. The foregoing being the case, I sentence the accused to Probation of 6 months under the supervision of the Probation Officer Imenti South Sub-County.
