The court found that the Senior Registrar of Titles, Mombasa, refused to register the deed of transfer from Ramada Ltd to Brawny Properties Ltd on the basis of the alleged existence of another title. However, evidence from the Director of Surveys and the Kilifi Town Clerk established that the other titles cited by the Registrar and the interested parties pertained to different parcels of land in Mombasa Mainland North Section VI, not the suit property in Kilifi Township. The Registrar's refusal was therefore based on extraneous and incorrect considerations, and there was no legitimate reason to deny registration.
