The High Court found that from 14th March, 2016, when the stay order in Malindi High Court Petition No. 3 of 2016 was issued, until 13th December, 2016, when the Court of Appeal stayed the execution and implementation of the judgment declaring the relevant statutory provisions unconstitutional, subordinate courts lacked jurisdiction to hear and determine environment and land disputes. The proceedings and judgment delivered by the Senior Resident Magistrate in Malindi CMCC No. 31 of 2016 during this period were therefore a nullity. The court held that jurisdiction cannot be conferred by practice directions or by the parties' conduct, and any actions taken without jurisdiction are void....
