Legal Issues
- 1 Whether the accused, as a first offender, should be granted a non-custodial sentence.
- 2 What weight should be given to the pre-sentence and victim impact reports in sentencing.
Ratio Decidendi
The court, after considering the accused's status as a first offender, his expression of remorse, the fact that he has already spent nine years in custody, and the recommendations of the pre-sentence and victim impact reports, determined that a custodial sentence was not warranted. Instead, the court found that a probation order would serve the interests of justice, rehabilitation, and community safety. The accused was therefore sentenced to three years' probation under the supervision of the Tigania Probation Officer.
