The court found that the prosecution proved the fact and cause of death but failed to establish that the accused unlawfully caused the death or acted with malice aforethought. The evidence showed the deceased was the aggressor, armed and intent on harming the accused, who was unarmed and acted in response to an imminent threat. Applying the subjective test for self-defence, the court held that the accused's actions were reasonable and necessary to protect his own life. The prosecution did not disprove self-defence beyond reasonable doubt. Consequently, the accused's conduct did not amount to an unlawful act, and the charge of murder was not proved.
