Procedural Posture

Criminal Case / Ruling on No Case to Answer

  1. 1 Whether the prosecution established a prima facie case against the accused persons to warrant their being put on their defence.
  2. 2 Whether suspicion alone, without corroborative evidence, is sufficient to infer guilt in a murder charge.

Ratio Decidendi

The court found that the prosecution's case was based on suspicion and uncorroborated evidence. The testimonies of the key witnesses were inconsistent and unreliable, with PW1 unable to identify the accused and PW2's evidence being suspect. The court held that suspicion, however strong, cannot substitute for proof beyond reasonable doubt. The prosecution failed to establish a prima facie case as defined in law, and therefore, the accused persons could not be called upon to defend themselves. In the absence of sufficient evidence, the court acquitted the accused under section 306(1) of the Criminal Procedure Code.
