The court found that while the safety of witnesses, particularly the 2nd Accused's husband, was previously a compelling reason to deny bail, the prosecution's failure to produce the said witness for over a year constituted a disregard of court orders and an infringement of the accused persons' constitutional rights. The prosecution could no longer rely on witness safety as a compelling reason, especially given the existence of legal mechanisms for witness protection. The court held that the balance of justice now favored the release of the 2nd and 3rd Accused persons on bail/bond, subject to strict conditions, and accordingly reviewed the earlier rulings to allow their applications.
