The court found that, although the Minister's Land Appeal decision was delivered on 5th July 2012, the computation of the six-month limitation period for filing an application for leave to apply for certiorari must exclude the period between 21st December and 13th January, as provided by Order 50 Rule 4 of the Civil Procedure Rules. After excluding these 24 days, the application for leave filed on 25th January 2013 was within the statutory period. The court further held that the Environment and Land Court has jurisdiction to grant prerogative orders such as certiorari in land matters under Section 13 of the Environment and Land Court Act.
