Ratio Decidendi

The court found that the Cabinet Secretary for Sports had no legal authority under the Sports Act, 2013 or any other law to disband the National Olympic Committee of Kenya (NOCK). Section 54 of the Sports Act only permits the Cabinet Secretary to appoint a person or committee to manage a sports organization or remove an official under specific circumstances, but does not empower him to disband an entire organization. The court held that executive powers must be expressly conferred by statute and cannot be exercised by implication. The Cabinet Secretary's decision was therefore ultra vires, made without jurisdiction, and in violation of the applicants' right to fair administrative action...
