The general rule under section 27 of the Civil Procedure Act is that costs follow the event unless there is good reason to depart from this principle. In this case, the proceedings were initiated due to the 1st Respondent's decision, but the proceedings became untenable due to the 2nd Respondent's cancellation of the tender.
