Applying the principles under Section 306(1) of the Criminal Procedure Code and the guidance from R. T. Bhatt v R, the court held that a reasonable tribunal, properly directing its mind to the law and the evidence, could convict the accused if no explanation is offered by the defence. Therefore, the accused is required to be placed on his defence to answer the charge of murder.
