Legal Issues
- 1 Whether the accused should be sentenced to a custodial or non-custodial sentence for manslaughter.
- 2 What mitigating factors should influence the sentence for the accused who pleaded guilty to manslaughter of his own child.
Ratio Decidendi
The court found that the accused, having pleaded guilty to manslaughter of his own son, was a first offender and the sole breadwinner for his family. The tragic and accidental nature of the offence, coupled with the accused's remorse and cooperation with the court process, warranted a non-custodial sentence. The court determined that a three-year probation order was appropriate, balancing the need for accountability with the mitigating circumstances and the welfare of the accused's dependents.
Court Disposition
Accused sentenced to three years' probation for manslaughter.
Orders
- The accused is sentenced to three years' probation.
- The Probation Officer shall file a report at the end of the three years.
