Procedural Posture

Miscellaneous Application / Ruling on Motion for Order of Mandamus

  1. 1 Whether the applicant is entitled to an order of mandamus to compel the respondent to pay the decretal sum.
  2. 2 Whether the application complies with the requirements of Order LIII rule 4(1) of the Civil Procedure Rules.
  3. 3 Whether the applicant can recover a decretal sum from proceedings to which it was not a party.

Ratio Decidendi

The court found that the application was fatally incompetent because the order of leave extracted was at variance with the order applied for, and the substantive motion sought to enforce a decree from proceedings (H.C.C.C. 237 of 2007) to which the applicant was not a party. The applicant's entitlement was limited to the decree in H.C.C.C. 236 of 2007, but the motion improperly sought payment under a different decree. This procedural irregularity contravened Order LIII rule 4(1) of the Civil Procedure Rules. The court held that the applicant could not recover a decretal sum from proceedings it was not party to, and the application was therefore struck out as incompetent.
