Ratio Decidendi

The court found that the prosecution had established a prima facie case against the accused, Victor Cheruiyot Langat, for the offence of murder contrary to Section 203 as read with Section 204 of the Penal Code. The evidence presented by ten prosecution witnesses was sufficient to require the accused to be put on his defence. The court therefore ruled that the accused must give his defence to the charge, as required by law when a prima facie case is established at the close of the prosecution's case.
