The High Court found that the trial magistrate exceeded his jurisdiction by engaging in constitutional interpretation, a function reserved for the High Court under Article 165(3)(d) of the Constitution. Furthermore, the court held that, following the promulgation of the 2010 Constitution, all state prosecutorial powers are vested in the Director of Public Prosecutions unless Parliament specifically legislates otherwise under Article 157(12). Section 167 of the Public Health Act, which predates the 2010 Constitution, does not confer prosecutorial powers on Public Health Officers in conformity with the current constitutional framework, as no post-2010 legislation has been enacted to that...
