Ratio Decidendi

The court found that the withdrawal of the case against the accused under section 87(a) of the Criminal Procedure Code after a conviction had already been entered was improper, as the statutory provision only permits withdrawal before judgment is pronounced. The court further held that, although the order appeared improper and would ordinarily invite revision, section 364(2) of the Criminal Procedure Code prohibits making a revision order to the prejudice of the accused without first giving him an opportunity to be heard. Therefore, the court ordered the accused to be brought before it to make representations before any revisionary orders are considered.
