Procedural Posture

Criminal Case / Ruling on Case to Answer After Close of Prosecution Case

  1. 1 Whether the prosecution established a prima facie case against the accused to warrant being put on his defence.
  2. 2 Whether the postmortem report was properly produced in evidence despite the absence of its maker.

Ratio Decidendi

The court found that the prosecution had established a prima facie case against the accused. The Postmortem Report was properly produced in evidence by the Investigating Officer, pursuant to the agreement of both counsel that the doctor and the identifying witness would not attend court and that their statements and the report would be produced by the Investigating Officer. The accused's argument that the report was not produced or that its maker was not called was therefore without merit. On the basis of the evidence adduced, the accused was required to be put on his defence.

Court Disposition

Accused found to have a case to answer and put on his defence.

Orders
