The court found that the prosecution had established a prima facie case against all five accused persons. The evidence of PW3, PW4, and PW6, who recognized the accused at the scene with the aid of motorbike lights and had known them for years, was considered credible. The identification parades were found to have been properly conducted in accordance with the Force Standing Orders, and the accused were not prejudiced. The court held that, at this stage, it is not required to determine conclusively whether the evidence is sufficient for conviction, but only whether it is sufficient to require the accused to make a defence. Accordingly, all accused persons were placed on their defence.
