Procedural Posture

Judicial Review / Ruling on Notice of Motion for Certiorari

  1. 1 Whether the Ileho Division Land Disputes Tribunal acted outside its statutory jurisdiction in determining ownership and ordering issuance of title deeds.
  2. 2 Whether the Tribunal's award should be quashed by an order of certiorari.

Ratio Decidendi

The court found that the Ileho Division Land Disputes Tribunal acted ultra vires its statutory mandate by purporting to determine ownership of land, order a government surveyor to demarcate portions, and direct the issuance of separate title deeds. Section 3(1) of the Land Disputes Tribunal Act restricts the Tribunal's jurisdiction to matters of boundary, occupation, and trespass, not title or ownership. Since the Tribunal's decision was made without jurisdiction, it was illegal and liable to be quashed by an order of certiorari. The court therefore allowed the application and granted the orders sought, with no order as to costs due to lack of opposition.

Court Disposition

Application allowed. Certiorari granted. No order as to costs.

Orders

  • An order of certiorari is issued to quash the proceedings and award of the Ileho Division Land Disputes Tribunal in claim No. 7 of 2011.
