Procedural Posture

Miscellaneous Application / Ruling on Bond Application Pending Trial

  1. 1 Whether the accused persons are entitled to bail pending trial under Article 49(h) of the Constitution.
  2. 2 Whether the prosecution has demonstrated compelling reasons to deny bail to any or all of the accused persons.
  3. 3 Whether the risk of interference with witnesses or flight risk justifies denial of bail.

Ratio Decidendi

The court held that the right to bail is constitutional and applies to all accused persons, including those charged with serious offences such as murder. The prosecution failed to provide specific and compelling evidence of likely interference with witnesses or risk to the safety of the accused that would justify denial of bail. The only exception was the 8th accused, Peter Mutiria Mucimi, who was found to be a flight risk due to lack of a known place of abode. For the remaining accused, the court found no compelling reason to deny bail and granted bond with strict conditions to ensure attendance and non-interference with witnesses.

Court Disposition

Bond granted to all accused except the 8th accused; 8th accused denied bond due to flight risk.

Orders

  • Bond of Kshs. 2,000,000 with one surety of similar amount granted to all accused except Peter Mutiria Mucimi.
  • Peter Mutiria Mucimi (8th accused) denied bond due to being a flight risk.
