The Tribunal found that its jurisdiction is strictly dependent on the existence of a landlord-tenant relationship as defined under Cap 301. Since both parties agreed that the tenant had vacated the premises and the property was now under the control of a third party, the foundational relationship had ended. The Tribunal therefore lacked jurisdiction to entertain any further claims or grant the substantive reliefs sought by the applicant. Furthermore, once a tribunal determines it lacks jurisdiction, it cannot make any further orders on the merits of the case, including findings on contempt or liability. The applicant was advised to seek relief in a forum with the appropriate jurisdiction.
