The Environment and Land Court found that, following the 2010 Constitution, judicial tribunals such as the Business Premises Rent Tribunal are subordinate courts with inherent powers to punish for contempt of their own orders. Section 14 of the Landlord and Tenant (Shops, Hotels and Catering Establishments) Act, which requires enforcement through magistrate's courts, is a pre-2010 provision that does not reflect the current constitutional status of tribunals. Therefore, the proper forum for contempt proceedings is the tribunal that issued the order, not the Environment and Land Court or any superior court.
