Ratio Decidendi

The court found that the interested parties acquired the disputed parcels from the plaintiff during active litigation (pendente lite), and their titles were cancelled following a lawful court order. Under Order 22 Rule 85 of the Civil Procedure Rules, purchasers from a judgment-debtor after the institution of suit are not protected from dispossession in execution of a decree. The court determined that the interested parties were not bona fide claimants entitled to resist execution, as their acquisition was expressly excluded by the rules.
