Ratio Decidendi

The court found that its previous order requiring the petitioners and the Kenya Forest Service to share survey fees was made in error, as the record showed that both parties and the State Counsel had agreed that the fees should be shared between the Kenya Forest Service and the Government. The court therefore reviewed and varied its earlier order to reflect this agreement. On the request to compel the Director of Land Adjudication to file Registry Index Maps and index diagrams, the court held that the petitioners' apprehension of possible abuse by surveyors was speculative and unsupported by evidence, and thus declined to grant the order. Costs were ordered to be in the cause.
