Ratio Decidendi

The court found that the claimant failed to discharge the burden of proof required under section 47(5) of the Employment Act, 2007 to establish that his termination was unfair. There was no evidence, either documentary or from pleadings, to suggest unfair termination. Consequently, the court did not require the respondent to justify the dismissal under sections 43 and 45 of the Act. However, the court held that the claimant was entitled to certain terminal dues not dependent on the fairness of the dismissal, specifically pro rata leave and wages for May 2013, as acknowledged by the respondent. The court also ordered the issuance of a certificate of service as a statutory right.
