Civil Suit / Judgment

  1. 1 Whether the Plaintiff paid the Defendant the purchase price of Kshs. 13,000,000 for Plot No. 004.
  2. 2 Whether the Plaintiff is entitled to an order of specific performance or a refund of the purchase price.

Ratio Decidendi

The court found that although the Sale Agreement stated the purchase price had been paid, there was no credible evidence that the Plaintiff actually paid Kshs. 13,000,000 to the Defendant. The Plaintiff failed to explain why payment was made before obtaining all completion documents or why payment was not witnessed by the advocate who prepared the Agreement. The court considered it highly unlikely that such a large sum would be paid in cash without any witness or documentary evidence. The Plaintiff only produced copies, not originals, of the completion documents. The court held that the Plaintiff did not discharge the burden of proof required to establish payment of the purchase price....
