The respondent failed to attend the hearing or provide any evidence to justify the termination, thus failing to discharge the statutory burden under sections 43 and 45 of the Employment Act. The dismissal was therefore both procedurally and substantively unfair. The court awarded the claimant compensation equivalent to five months' gross salary for unfair termination, one month's salary in lieu of notice, and ordered the issuance of a certificate of service.
