Ratio Decidendi

The tribunal found that the landlord failed to dislodge the presumption of proper service established by the process server's affidavit. No affidavit was provided by the landlord's advocates to corroborate his claim of non-service, nor was the process server summoned for cross-examination. The tribunal was satisfied that service was proper and the ex-parte orders were regular. Furthermore, since the order had already been adopted by the subordinate court under section 14 of Cap. 301, the tribunal was functus officio and lacked jurisdiction to set aside the order. Consequently, the landlord's application was dismissed with costs to the tenant.
