Ratio Decidendi

The court found that the mediation agreement, though adopted as a consent order, was not fully implemented as the trust for the benefit of the children regarding Langata Plot No. 24xxx had not been prepared or registered. The court held that functus officio does not apply until all terms of the consent are fulfilled. Since the trust was a key component of the settlement and remained outstanding, the court determined that the matter should be referred back to mediation to resolve the issue.
