Ratio Decidendi

The court found that although the appellant failed to prove a contractual entitlement to 4% monthly interest due to lack of documentary evidence, the trial court erred in awarding no interest at all for breach of contract. The court held that, under Section 26 of the Civil Procedure Act and established case law, interest on liquidated sums is discretionary but should be exercised judiciously to compensate the party deprived of funds. Since breach was admitted and the respondent proposed 12% per annum in submissions, the court exercised its discretion to award interest at 12% per annum on the consented sum of Kshs 500,000.00 from the date of filing suit until payment in full.
