Ratio Decidendi

The court found that the applicant failed to provide evidence supporting his claim that he resides in Uasin Gishu or that the contract was entered into in Eldoret. The respondent’s evidence that the contract was entered into in Nairobi and that its business premises are in Nairobi was unchallenged. The court held that the suit was properly filed before the Milimani Chief Magistrate’s Court in Nairobi, as the cause of action arose there in accordance with Section 15(c) of the Civil Procedure Act. The applicant’s application for transfer was therefore without merit and was dismissed with costs awarded to the respondent.
