The court found that although the claimant's pleadings and submissions regarding the balance of annual leave days were ambiguous and lacked specificity, the payslip for March 2016, authored by the respondent and forming part of the evidence, clearly indicated that the claimant was owed 45 days of annual leave. This documentary evidence was uncontroverted and sufficient to establish the claim. The court acknowledged its earlier error in overlooking this evidence and held that the application for review was merited. The computation of Kshs. 277,725 for 45 days of annual leave was uncontested, and the court exercised its review jurisdiction to amend the judgment to include this award.
