Ratio Decidendi

The appellant failed to prove negligence against the respondents on a balance of probabilities. Although the occurrence of the accident and the appellant's injuries were established, there was no evidence as to how the accident occurred or that it was caused by the respondents' negligence. The doctrine of res ipsa loquitur could not be invoked in the absence of evidence pointing to negligence, and the appellant did not discharge the burden of proof required by law. The appeal was also filed out of time without evidence of leave being granted. Consequently, the trial court's dismissal of the suit was upheld and the appeal dismissed.
