Miscellaneous Criminal Application / Ruling on Application for Consolidation of Sentences

  1. 1 Whether the High Court has jurisdiction to consolidate sentences imposed by courts of different hierarchies.
  2. 2 Whether the applicant's sentences from separate cases can be ordered to run concurrently.
  3. 3 Whether the offences in question are of the same or similar character or arise from the same facts to warrant consolidation of sentences.

Ratio Decidendi

The court held that there is no legal provision allowing consolidation of sentences imposed by courts of different hierarchies. The offences for which the applicant was convicted occurred on different dates, in different places, and were not part of a series of offences of the same or similar character. Furthermore, the applicant did not appeal or seek concurrent sentencing at the appropriate appellate stage. The High Court cannot review or alter its own appellate decisions in this context, as doing so would amount to exercising appellate jurisdiction over its own judgments, which is impermissible. Therefore, the application for consolidation of sentences lacked merit and was declined.
